But for some reason the one that is under right click mesh modifier menu works. (under windows7 64bit). Does it sound like a bug?

Apologies for the slow response - for some reason this didn't show-up in my news reader.
Anyway, not a bug, but a deficiency in the UI. The "Create" menu is a general-purpose menu that creates whatever you ask of it ... period. The mesh modifier menu is creating the filter and hooking it into the pipeline.
